Court Grants N50,000 Bail To 22-Year-Old Cook For Alleged Trespass

A Gudu Upper Area Court in the Federal Capital Territory on Tuesday admitted a 22-year-old cook, Peter Hassan, to bail in the sum of N50,000 for alleged trespass.
Hassan of no fixed address is being tried on a one-count charge of criminal trespass, contrary to Section 348 of the Penal Code.

The presiding officer, Alhaji Umar Kagarko, ordered the defendant to produce one reliable surety in like sum.

Kagarko said that the surety must reside within the court’s jurisdiction, and adjourned the case till Aug. 15 for hearing.

The Prosecutor, Urom Otu, had told the court that the Chief Security Officer of Emirate Park, Area 3, Garki, Abuja, reported the matter at the Garki Police Station on June 13.

Otu said the defendant was apprehended when he was sighted at the park by the security guards on June 12.

He said the defendant climbed the fence to gain access into the park, but was chased and arrested by the security guard on patrol duty, who handed him to the police.

He said the defendant was unable to give any satisfactory account of his action during police investigation.

Similarly, Martins Emmanuel, 40 of Angwan Tudun-Wada, Masaka, Karu, Nassarawa state, pleaded not guilty to the charge of criminal trespass, stealing and public nuisance.

Otu told the court that Abel Freeman of Bwari Close Station reported the incidence at the police station on June 12.

Otu said the defendant had criminally trespassed into the compound of the complaint through the fence to steal.

He said that the defendant was apprehended and a wrap of dried leaves suspected to be cannabis sativa was recovered from his possession.

He said the offences contravened Sections 348, 95 and 198 of the Penal Code.

Kagarko granted bail to the defendant in the sum of N50,000 with one surety in like sum.

Kagarko said that the surety must reside within the jurisdiction of the court, and adjourned the case till Aug. 15 for hearing. (NAN)
